In taped interrogation, Westerfield tells police 'my life is over'

In a videotaped interrogation with San Diego police detectives four days after Danielle van Dam was kidnapped, an exhausted David Westerfield says "my life is over," seemingly coming close to an admission that he murdered his 7-year-old neighbor.

"As far as I'm concerned my life is over, the life that I had, the life that I was living is over," Westerfield says in the interrogation conducted the evening of Feb. 5, 2002. Danielle was last seen the night of Feb. 1.

"But you can't blame anyone but yourself, Dave," answers one of the police detectives.

"And I have no problem with that," Westerfield replies.

In the tapes released Tuesday, Westerfield admits "unusual" sexual encounters with his wife, denies anything improper about his alleged use of binoculars to watch neighbors and says the child pornography found on his computer was simply something he downloaded along with a lot of other pornographic images and that he had no sexual interest in children.

Superior Court Judge William Mudd agreed Monday to unseal the videotape along with hundreds of pages of transcripts, documents and recordings in the Westerfield case, as well as transcripts of police interrogations and court hearings conducted in secret.

Some of the material – audiotape and videotape of Westerfield being interrogated during the early stages of the investigation – was released Tuesday afternoon.

The remainder of the material, which ranges from transcripts of closed-door court hearings to motions regarding potential evidence, will be released Monday, Mudd ruled.

The ruling Monday came three days after Mudd sentenced the former design engineer to death for kidnapping and murdering 7-year-old Danielle van Dam, his neighbor in Sabre Springs.

Monday's court hearing came in response to a request by The San Diego Union-Tribune, which has been seeking access to the information for months. The San Diego-based 4th District Court of Appeal has ruled that Mudd must release the information.

The San Diego chapter of the Society of Professional Journalists made a donation to the legal costs.

Westerfield, who attended Monday's hearing, is scheduled to be moved within days to death row at San Quentin State Prison outside San Francisco.

During earlier court appearances, Westerfield was always dressed in civilian attire, but he appeared in court Monday in a green jail jumpsuit. He sat in a holding area so he couldn't be filmed by a television camera.

I agree. Then why all this fuss over it? Why is it so important, and was so important during the case to convince the jury DW raped Danielle? In the MH ? Because without the rape, the murder has no meaning. No motive. Doesn't compute. Since there is no proof of rape, the Prosecution had a hard road to hoe. So they went around most of the proof issues. They stuck with the HE raped her therefore he killed her;He killed her therefore he raped her. You don't need any other proof. Just find him guilty and you can go home. There was just enough physical evidence to get the jury to see it that way. If that evidence was planted, or the result of contamination, then they have NO CASE.

The facts that tracking dogs did not hit where they should have TO CONFIRM that there would be PHYSICAL EVIDENCE to be found and used makes the planting of evidence seem much more likely.

The fact that DW is a sexual deviant is being used as support for rape and murder. The rape I already mentioned is a non-fact and DW is one of a ton of SEXUAL DEVIANTS, including the Van Dam parents. The fact that there are SWAP CLUBS aplenty in and around SAN DIEGO means that there is a substantial section of the population around there that are SEXUAL DEVIANTS.

So, if that is supportive of RAPE/MURDER, the police didn't interview nearly enough people.

Thank you for being so kind in your response. I try to remember that it is the issue that has us all so quick to jump at each other. Your or Cyn's stance is not at question. No one's stance is the question. Whether the information we get is correct or not, to get us to believe one way or another is at issue. Whether DW killed Danielle is the issue, not who thinks he did or didn't.

Again, I apologize for any personal attacks or things that appear to be personal attacks against you.

Now, the issue.

So far I have not seen anything the remotely consitutes proof of murder, in the recently released documents. Have you?

I don't know if it's EVERYTHING, but it's all of the hearing transcripts that have been transcribed. I really don't know if there's more.

Wonderful. Glad to hear they were checking for leaks, rather than hear about it some other way (on the news, after it blew up).

Well, Since it is all there, and you and others provided a multitude of links, now I can concentrate on readling and listening to it all.

I still have only seen and heard supportive evidence, no damning or irrefutable evidence of murder, or even rape.

Of course, I didn't really expect to, as it would have been presented in court, and not after the fact.

So far, much of what has been seen/heard supports DW's statements from the beginning. (IMHO)

The Polygraph. That would be very supportive, if it had been provided in court. The idea that the police use it as a way of 'scaring' a suspect into admitting guilt, and that it is very possible it was used that way in this case, is scary too.

DW stated he knew nothing about PG exams. So, the fact that Redden showed him the chart, makes it hard to prove because Redden could have said anything about it, and DW had no way to dispute it.

Also it was said that Redden had another PG exam expert look at it and he said the same thing. This possibly provides some support for it's veracity, but not if the other person was 'in on the scam'.

Why so distrusting, you ask? I have stated it over and over.

Did you see that the GOV of ILL. released/pardoned 4 inmates from DEATHROW because of the corruption in the police department and justice system ???????? That he has people looking into all capital punishment cases due to this? That it is possible hundreds of innocent people were convicted??????????????????????????????????????????

I just talked to my niece in Orange County. She tells me that a California TV station did an investigation and found that the builders of the subdivision where Westerfield and the van Dams lived only used FIVE different lock systems in the entire development, so most peoples' keys fit a lot of different houses.

Exposing past corruption in their state to cover current corruption in their office, yes.

This is an open question, anyone jump in if they can explain it.

If I just forget everything, and accept the verdict,accept DW did it, then I keep coming up with this mystery.

HOW /WHERE/WHEN?

The jury was told HOW/WHERE/WHEN didn't matter in this trial, and I find that UNACCEPTABLE.

I think it is the most important thing. Someone provide a TIMELINE that matches up to everything and proves DW could have done this.
