Judge Napolitano, (Who served in NJ) confirmed my reading of the Law, on the point.
They are legally disallowed to cange the ballot inside of 51 days.
If Torch Resigns, he can be replaced by the Governor, as a Candidate outside of thirty days.
If he resigns Inside of thirty Days, McGreevy can appoint a successor to fill the vacancy. And Suspend the Election till 2003
That having been said SCOTUS will likely take a very dim view of that, because the term of the senate is 6 years not seven, but anytime you are forced to rely on the courts, you may as well be flipping coins, and politically, will SCOTUS really want to decide for a Republican, in a case that determines the Majority, so close to being accused of perfidy in the 2000 election (wrongly, but nonetheless).
The only other hope is that the Republicans win the Majority wiithout NJ, then disqualify whomever (if not Forrester) NJ sends to Washington (The Senate is the Sole Constitutional judge of elections to that Body)
