The actions of an innocent man.... Or one who reads the handwriting on the wall, or maybe a total hypothetical posed to the detectives by Feldman ("if you offer leniency in exchange for revealing where the body is, I'll ask Westerfield to consider it" when in fact Westerfield had not revealed to Feldman any knowledge of the matter at all).

Feldman wouldn't even ask DW before using such "what if" senerios.
People forget the van Dams said that they were never asked about this either; if a deal was close they would have been asked to approve it. They said, "don't believe what you read in the papers".

Huh? I thought the issue was: Did David westerfield tell investigators that he knew where the body was? The answer is NO.

Or the actions of a good lawyer feeling out the opposition.Replace the word "good" with "competent" if you'd like (I'd prefer "sleazy").
Why would any defense lawyer posit such a deal unless he presumes his client's guilt--
"Gee, Mr Westerfield, we got you life in prison just as long as you lead investigators to the body. Now we know, of course, that you weren't connected to the crime, and don't know where the body is, so we've contacted a psychic who's had very good success located missing persons....

If I called you up and said, "Look Billy we know you killed that girl. Tell you what, you tell us where the body is and we'll see that you get life". And, the press (or one of their informants) overheard that end of the conversation, YOU might be the subject of this rag piece.

To make the deal, yes. I believe you profer a statement first that can not be used against you. The "deal" was never made, it was just a bunch of lawyers feeling each other out.

Why not just go ahead with the deal then and save the state big bucks. Westerfield would switch his plea to guilty and get life, which is not much different than the death by age 67 or never, his going to get now. State get a big, fast sure win.
BTW: Did you know that Judge Mudd is one who reversed a jury death decision a few years ago, and gave the guy life?
