SIGNONSANDIEGO August 14, 2002 The judge in the trial of David Westerfield today allowed reporters to see court log entries of notes from jurors, as well as letters to the judge from the public about the murder of Danielle van Dam. The letters from the public included a variety of theories about the case.
One letter-writer sent the following theory to Judge William Mudd: "Danielle van Dam killed herself.'' A nearly illegible postcard with a Spokane postmark alluded to at least one ex-wife "with a drinking problem (who) lives in Spokane.''

The writer failed to indicate whether the reference was to ex-wives of Westerfield – who has been married and divorced twice – or someone else connected with the case. The postcard was unsigned. Another missive came from a man who referenced another high-profile murder trial – that of O.J. Simpson. "The O.J. Simpson case was a miscarriage of the state's justice mainly because Judge (Lance) Ito was too lenient with the actors defending O.J.,'' the man wrote. There was no news Wednesday afternoon about the status of deliberations, but Mudd announced he was holding a sealed hearing 9:30 a.m. Thursday to consider an unspecified defense motion in the case. Wednesday was the fifth day of deliberations. The prosecution concluded its closing arguments last Thursday. Westerfield is accused of kidnapping 7-year-old Danielle van Dam from her Sabre Springs home and killing her. He could face life in prison or the death penalty if convicted of murder with special circumstances. He has also been charged with misdemeanor possession of child pornography. The log entries show that on Friday, the jury requested ``all available evidence of pornographic images'' and a photograph of a teen-age daughter of the defendant's ex-girlfriend.

Yes...this just adds the more to the unanswered questions surrounding this case.
Also, the tooth may have been taken out shortly after her death, before bad decomposition set in..or God forbid, as others have talked about earlier, it could have been extracted whilst she was alive. :-(

I can pick up on Feldman's vibes. He's pi$$ed every time
he enters that courtroom. He's (fuming) angry with Doosuk,
the whole of LE, the media & the judge.

I've been out and about and been reading some of the great comments on this thread today and tonight.
Yes, she was cremated. She was cremated too quickly at the request of the family.. not even a wake, albeit the casket would have been closed because of her "condition".
No second chance for an autopsey..DNA..or anything.
In fact, Feldman and company requested to be allowed into the Van Dam house before the trial, and Damon and Brenda turned them down by saying "We don't want EVIL in our home again"...that's that!

The theory(an old one I never posted) is that it happened after everyone was there.
And it's also unreasonable because the bedroom door wouldn't knock her down the stairs.

Forgot to add, Feldman didn't mention it either. Unlike the PROSECUTION, DEFENSE is not allowed to use IMAGINARY EVIDENCE. I.E. Feldman couldn't say a TOOTH was used to plant DNA if he had no evidence of a TOOTH in possession of the SDPD.
DUSEK, however, is trying to convict DW on a 'missing' blue blanket, 'missing' black boots', orange/blue/grey fibers from an 'unknown' source, and an 'imaginary' RAPE!

No, no. I didn't mean that. I meant he didn't mention
being able to extract DNA from teeth. Not in reference
to planting evidence. Feldaman could have inquired about
DNA from teeth.

The child was cremated? Was there any open casket wake at all for others to accept this death? DOn't think so. The VD's had the flowers that 'morners' left moved to a location that was good for 'a setup' shot by the Media. Wanted to make sure the cameras got all of it, got max. public sympathy, exposure, etc
Besides, they apparently had 'accepted' her death before they called police.

You would think Mudd would be more lenient towards the defense..after all, a man's life is at stake here.....innocent til proven guilty...at least it used to be that way, in the USA.
