Is Padilla an enemy combatant of the US? Or do you doubt the merits of holding him until a prima facie case can be made in a military tribunal? Why do you want to go to bat for a maggot like Padilla?Is it no more than Jesuitical exercise in free debating for you?

Respectfully, I think you have just been confused by his removal from civilian to military authority. Maybe you're thinking of the denial of h-b because he was moved and no longer in the venue it was filed earlier?

AFAIK his h-b from the military jail has not been ruled on.
