I must have missed that part of the Constitution where one is presumed guilty until proven innocent.

Did you also miss the part where a judge must determine if the person is a danger to himself or others before removing the weapons?
How is this different from a judge deciding that a person is a danger to himself or others and commits that person to a mental institution?
