Birthright taxpayers

If we play this right, we can attack China with the fiercest enemy known to man: The IRS, and that's no joke.

here are times when the obvious hits you between the eyes with such force that you just can’t take two aspirin and wait for dawn. Trump v. Barbara did just that. There are supposedly about a million Chinese “birthright citizens” who can now vote in US elections. That also means that they are US taxpayers. Hmmm… Time for a little thought experiment.

These US citizens in China are subject to the Internal Revenue Code. That means that they must file Income Tax Returns annually, just like the rest of us. Failure to File is usually a civil offense under IRC § 6651. If there is a willful decision not to file, it becomes a federal misdemeanor under 26 U.S.C. § 7203. That’s worth a year in the crossbar hotel and a $25,000 penalty for every year a return isn’t filed.

Let’s assume Trump tells Secretary Bessent to pursue this avenue. Assuming mass compliance, the US Treasury will get money from China. They will get all the headaches, including Taxpayer Compliance Measurement Program audits.

“What’s that?” you ask. Having been through a TCMP audit, they’re not fun. The auditor will demand detailed records on everything you did financially for the year in question. Your Quicken files aren’t allowed. Your checkbook is no good. You must bring bank statements, which is fun in an era of electronic banking. I even had to get a letter from a law firm documenting a donation to a church because there were legal issues involved. You get the picture. Every drive-through lunch gets checked.

The number is probably not as high as a million because those birth tourism packages that were being sold were not cheap.

Frankly, most of these families would rather get their money converted to dollars and pay the IRS than leave it in Yuan and let it get devalued by the CCP.

The whole idea behind Chinese birth tourism is to give the family an escape if needed, and to give their kid access to American universities and/or a job in the US without having to get a visa.

Money is no object and they’ll pay the IRS without complaint, because the IRS won’t throw you in a labor camp or shoot you in the back of the head and bill your family for the bullet.

Probably not at all. Remember, the IRS is big, bloated, cumbersome government bureaucracy. To even send them notices, it needs to have records, in Chinese, of these people, not to mention their bank accounts, assets etc...

It will need to have organized teams, software, systems, etc... to identify and track these so-called Americans living abroad. Is the IRS organized this way? I doubt it

The IRS receives ZERO assistance from the Chinese Govt, especially in the banking area. China is a complete black hole, as is much of the 3rd world.

Also, let's say they find a person, living in China for 20 years, who has never paid US taxes. Are the IRS ready to enforce it? Does the IRS work with Customs and ICE to arrest tax delinquents at the border upon entry? Does the law even allow it?

The Chinese government might be persuaded to persuade them to denounce their US citizenship.

Of course, their parents would not like PRC officials to take an interest in them so the parents might be allowed under US law to denounce US citizenship for birth tourism minors.

The big problem is that an anchor baby can be used to put a whole family on welfare big time.

That welfare might be limited to say:
1. WIC, SNAP, medical stuff [Medicaid, KidsCare, PPACA subsidy] for the anchor baby alone
2. Section 8 at 10% of allowable rent, for the anchor babies alone, each, up to two per household

Congress should fix the welfare system.

Great Idea, require these newly minted citizens to file taxes and if not living full time in the U.S. make them pay a $25,000 annual fee.

Taxes may be reduced but not eliminated.

And....There are the fines for not filing, and the irritation and time needed to file, if they do pay taxes. Finally, many foreign banks will not accept American citizens as clients because these banks don’t want the hassle of dealing with the American IRS.

Against my better judgement, I will feed the troll. If you don’t file, there are automatic penalties that no foreign tax credit can offset.

I think the government should place a “processing tax” on anchor baby parents. Tax to process the birth certificate, maybe a $100,000 tax. Plus remove the new U.S. CITIZENS from their non-citizen parents before deporting them.
Then bill them for child support.
