I feel like all laws where there was an attempt but you failed should carry the same penalty. Just because you are bad at something or just lucky should not be rewarded.
I do remember a case in Maryland though where a person was convicted of attempted manslaughter but they realized after the fact that it is not a legal possibility based on the definition of manslaughter. Manslaughter is the unintentional taking of a life so you cannot attempt to do it. Can’t find the reference but it was quite embarrassing for all involved.
