The U.S. Constitution and Common Law.

Reiterated in Dred Scott v. Sandford (1857): Supreme Court Justice Peter Vivian Daniel, in a concurring opinion, quoted an Emerich de Vattel's 1758 treatise The Law of Nations for a definition of natural-born citizen: "The natives, or natural-born citizens, are those born in the country of parents who are citizens".

Reiterated in Minor v. Happersett (1875): "The Constitution does not, in words, say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that. At common-law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives, or natural-born citizens, as distinguished from aliens or foreigners." - Chief Justice Waite

Marco Rubio was a foreigner until his parents became citizens. His parents were "subject to the jurisdiction" of Cuba until they became citizens and could be recalled as the Cuban government saw fit. As such, Marco Rubio was absolutely "subject to the jurisdiction" of Cuba, not the United States.
