“Fraud vitiates everything” (I realize it was an opinion by a judge and not part of the settlement). The Auto-Pen was done fraudulently. I would think there is basis to void everything done by Auto-Pen. Then again I dont trust Roberts.
Executive Orders are, by definition, orders given by the President to employees of the Executive Branch. Confirmed federal district and circuit judges, as well as Supreme Court justices, are all employees of the Judicial Branch. He literally can't order them to do anything.
Never mind - they're on a roll. Don't confuse them with the facts or the law.
Two things come to my mind:
1. It generates a cloud of suspicion over her nomination and confirmation. That cloud will never go away.
2. I thought Executive Orders applied only to the Executive Branch. Her “confirmation” is a Judicial Branch item.
Well, is it possible to vacate their opinions?
