Deputy AG Todd Blanche Warns California Dems to ‘Stand Down or Face Prosecution’ After Pelosi Threatens to Arrest ICE Agents

Department of Justice Deputy Attorney General Todd Blanche on Thursday warned top California Democrats to “stand down or face prosecution” after Rep. Nancy Pelosi (D-Calif.) threatened to have federal law enforcement agents operating in her district arrested.

Pelosi stated in a press release Wednesday that San Francisco police may arrest federal agents if they are found violating state law during U.S. Immigration and Customs Enforcement (ICE) raids. Blanche stated on Friday that any officer who lays a hand on federal law enforcement will be committing a crime.

The former speaker issued the press release in reaction to “reports of a planned mass immigration raid” in the San Francisco area, and denounced the raids as an “appalling abuse of law enforcement power.”

President Trump has since put on hold his decision to send 100 additional ICE and federal agents to San Francisco, giving the local government one more chance to tackle the city’s high crime problem.

“It is important to note that California law protects communities and prevents federal agents from taking certain actions here that we have witnessed in other states,” Pelosi stated on her press release.

“While the President may enjoy absolute immunity courtesy of his rogue Supreme Court, those who operate under his orders do not. Our state and local authorities may arrest federal agents if they break California law—and if they are convicted, the President cannot pardon them,” she added.

The 85-year-old concluded that San Francisco residents will “continue to stand with the patriotic immigrants who are the constant reinvigoration of America.”

San Francisco District Attorney Brooke Jenkins said in an interview that she had come up with the strategy after seeing federal agents allegedly “roughing up people in Los Angeles and Chicago,” according to the New York Times.

Jenkins reportedly said she had already spoken with the San Francisco Police Department about having officers review camera footage of federal interactions and then identify agents if they believed excessive force was used. She said they’d have a judge sign warrants to arrest and prosecute the ICE agents if they are deemed to have used excessive force. Jenkins reportedly said SFPD had agreed with the plan.

Thursday evening, Blanche sent a warning letter to Pelosi, Jenkins and two other California Democrats; Governor Gavin Newsom, state Attorney General Rob Bonta.

“California politicians want to arrest federal agents for enforcing federal law. We just sent them a letter: Stand down or face prosecution. No one threatens our agents. No one will stop us from Making America Safe Again,” Blanche wrote in a post on X.

In the letter, Blanche noted that instead of “supporting and working” with federal officials, the Democrats have called for state and local law enforcement to “arrest” officers who are only “enforcing federal laws enacted by the U.S. Congress, including federal immigration laws.”

The Deputy AG made clear that any attempt to arrest federal agents would be considered by the Justice Department as “both illegal and futile.”

“Accordingly, you are hereby directed to preserve all written and electronic communications and records related to any attempts or efforts to impede or obstruct federal law enforcement officials,” the letter continues. “We urge you and other California officials to publicly abandon this apparent criminal conspiracy, to stop threatening law enforcement, and to prioritize the safety of your citizens.”

“In the meantime, federal agents and officers will continue to enforce federal law and will not be deterred by the threat of arrest by California authorities who have abdicated their duty to protect their constituents,” Blanche concluded.

The DOJ also dismissed a new California law banning face masks worn by federal law enforcement agents to protect themselves from leftwing doxxing and harassment efforts. The legislation, signed by Newsom in September, takes effect in January. The Trump administration has made clear that it does not plan to comply with the state law.

The Democrats’ threats to arrest federal agents in the line of duty represents a serious and dangerous escalation in their inflammatory anti-ICE rhetoric that could potentially result in a violent clash between deep blue sanctuary state law enforcement officers and federal law enforcement agents.

According to the Department of Homeland Security, ICE has seen a 1000 percent increase in violence against agents as they carry out their operations.

Blanche told Fox and Friends Friday that the Democrats’ increasingly unhinged anti-ICE posturing “does nothing but harm this country.”

“You can not touch federal agents when they’re doing their jobs,” he stated. “That’s something they know and it’s something we reminded them of last night. Because if you do, you’re committing a crime.”

In a lengthy Truth Social Post Thursday, Trump stated that after speaking with San Francisco Mayor Daniel Lurie, he would hold off on sending federal agents to the city. Trump said some of his tech friends had also urged him not to do it.

“The Federal Government was preparing to “surge” San Francisco, California, on Saturday, but friends of mine who live in the area called last night to ask me not to go forward with the surge in that the Mayor, Daniel Lurie, was making substantial progress,” Trump said.

“I spoke to Mayor Lurie last night and he asked, very nicely, that I give him a chance to see if he can turn it around, ” Trump continued. “I told him I think he is making a mistake, because we can do it much faster, and remove the criminals that the Law does not permit him to remove.”

Trump said, “I told him, ‘It’s an easier process if we do it, faster, stronger, and safer but, let’s see how you do?’”

The president added that “the people of San Francisco have come together on fighting Crime, especially since we began to take charge of that very nasty subject.”

He noted that “Great people like Jensen Huang, Marc Benioff, and others have called saying that the future of San Francisco is great. They want to give it a ‘shot.’ Therefore, we will not surge San Francisco on Saturday. Stay tuned!”

The San Francisco Standard reported in December 2024 that more than 40,000 people in the city were facing deportation.
