Huh? I thought that the 100K H1-B was a one-shot application fee, not an annual “tax”. Fees can be set by the Executive, taxes must come from Congress.

The $100,000 fee is a one-time fee, not a yearly tax, and applies to employers filing for new H-1B petitions on or after September 21, 2025. This fee does not apply to existing H-1B visa holders or to the renewal or extension of current visas.
The US Chamber of Commerce and Club For Growth are lying open borders swine.

fees in my proposal
a. $2,000 per bid fee [to deter bogus/duplicate bids & prevent auction system denial of service], plus
b. a winner fee of 10% of the bid salary, or $8,000, whichever is higher [to compensate for reduced domestic search costs],
c. an annual inverse salary fee of 10% of the salary amount less than $200,000 plus 20% of the salary amount less than $120,000 [to help ensure the program is only used to supply highly skilled people], plus
d. a payroll health coverage cost savings fee of $6 per week per year of age under age 65 [so highly experienced Americans not replaced by cheap, healthy young foreigners]

The question is whether or not the statute passed by Congress that created the H-1B program authorizes the President to impose a fee that is in excess of the reasonable cost to process an application.

I don't know the answer to that. If it does, Trump is right. If it doesn't, the Chamber would be.
