So another egotist of a Judge agrees these Judges are out of control and abusing their authority but wants to rule on technicalities instead.
“Fair enough, as far as it goes,” Cullen wrote. “If these arguments were made in the proper forum, they might well get some traction.”

“...Co-equal branches...”
But in this case, one branch (Judicial) is claiming to be more equal than the other (Executive).
They are usurping the power and decisions from the Executive, chief law enforcement officer of the United States. NOBODY voted for those filthy corrupt rogue Maryland “judges”.

The judiciary are supposed to be independent of ephemeral pressure from having salaries cut, etc., in individual cases.
But they have abused this independence:
- By granting themselves complete immunity from civil and criminal prosecution;
- Trampling the Constitution by inventing rights not rationally derivable from it;
- Allowing restriction of clearly enumerated rights like the 2nd Amendment;
- Gutting the Commerce Clause restrictions on Congressional authority
- Making up new rules of process and procedure not stated in law or the Constitution
- Granting special rights and privileges to ethnic minorities and illegal aliens.
Their chain needs to be yanked hard.

This is a lie. The branches are not equal. The Judicial was always intended to be the weakest of the three and for good reason given the Founding Father's experience with judges in the British Imperial system.
Given Gorsuch's recent clear warning to lower courts these self-aggrandizing, activist judges will soon be put in their place.

For clarification, Flavius, meaning the myth of ‘Co-Equal’ branches is a lie, not your post ;-)

So another egotist of a Judge agrees these Judges are out of control and abusing their authority but wants to rule on technicalities instead. Judges don't get to do just what they think is "right". They have to follow the law, and that includes the right procedures. This was a very stupid way to attack that decision in the first place, and I'm quite sure that competent legal advice suggested not doing it like this.
But, it is likely either some hardliners or the President himself decided to do theu wanted to go personally after the judges, so they did this instead.
Play stupid games, win stupid prizes.
To: Frank Drebin
This judge isn't an activist. He ruled correctly given the procedural way the Trump Administration chose to attack the Order.
Legally, it was just stupid. My guess is the Trump Administration was able to cite little or no precedent for the relief it was seeking. If you can't give the judge a road map as to how he can lawfully do what you want him to do, you can expect to lose every single time.

And while I of course agree with what the administration is trying to do, this would open a HORRIBLE precedent to have used against us. We’ll win it eventually
