If you aren’t a treaty signatory you aren’t obligated by any law to abide by said treaty. That’s not a violation of anything.
The violators are those who signed nonproliferation treaties in order to get a free pass while they intentionally violated the treaties they signed, or who violated nuclear treaties by signing them in order to receive help with civil nuclear energy research, while actually intending to use the allowed civilian research to serve as cover for weapons research they had signed away the right to do.
