Alan Dershowitz Predicts Trump Will Be Victorious In Riot Lawsuit

Constitutional scholar Alan Dershowitz predicted on Monday that Gov. Gavin Newsom’s lawsuit against President Donald Trump over the Los Angeles riots will go down in flames, just like his city.

Speaking on his program “The Dershow,” Dershowitz expressed doubt that the U.S. Supreme Court would “second guess” Trump’s decision to federalize thousands of California National Guardsmen and deploy them to the epicenters of riots taking place across L.A. Gavin quickly sued Trump, accusing the president of “unlawfully” ordering soldiers under his control to put down the unrest.

“The Supreme Court will not second-guess the President of the United States on this issue,” Dershowitz said. “They will say, whether right or wrong, the president had the authority to make this decision and he had the authority to make it over the lack of consent of the governor,” Dershowitz explained.

“Let’s be clear, there was violence. You can see it on television; there were bombings, fire bombings, and burnings of Teslas and other self-driving cars. There were rocks being thrown at ICE officers. There were threats against ICE officers, threats against their families. Was it a full-blown insurrection? No.”

In addition to 4,000 National Guard soldiers, Trump has sent 700 Marines to L.A. to end riots now in their fifth day after U.S. Customs and Immigration Enforcement officers arrested upward of 150 illegal immigrants over the weekend. The operation quickly drew protestors who morphed into rioters, hurling cinderblocks at ICE agents and smashing their way into stores while looting anything they could carry.

Fox News’ Bill Melugin showed footage from inside one of the ICE vehicles pelted with rocks on Saturday, including the aftermath from rocks shattering a windshield. One immigration official said he suffered an injury from the attack.

Dershowitz predicted the high court would likely rule against Newsom and determine that President Trump was within his rights to activate the National Guard under the auspices of protecting civil rights.

“My prediction is: the lawsuits will fail. They’ll work in the federal district court,” Dershowitz said. “You’ll get, you know, the governor of California will find a federal district judge probably one he was involved in appointing and you’ll get some district court judge saying, maybe even issuing an injunction saying, the president of the United States can’t do this.”

“It’ll be appealed immediately, but when the case gets to the Supreme Court in the United States, they would have no choice or little choice, but to hold that the judiciary cannot interfere with the discretionary judgment of the executive head of the executive branch, the president, about the necessity for sending in troops,” Dershowitz added.

Newsom, who is believed to be positioning himself for a presidential run in 2028, has accused President Trump of aggravating the violence by calling up National Guardsmen under his control.

“Donald Trump is reckless, he’s immoral,” Newsom said on Monday. “He’s acting unlawfully. He’s putting people’s lives at risk. And it’s my job to clean up Donald Trump’s mess, because he’s making it by the hour.”

Dersh claims this was “rioting”, but it wasn’t an insurrection. Then he lists everything the bastards did but leaves out the obvious clincher which destroys his argument—the triumphant raising and waving of multiple Mexican flags.

Typical lawyer.

Let me understand. With “bombings, fire bombings, and burnings of Teslas and other self-driving cars, rocks being thrown at ICE officers, threats against ICE officers, threats against their families” this was not a full insurrection. What exactly was missing to make it a full insurrection.

Insurrection: an act or instance of revolting against civil authority or an established government

Insurrection Act: The act allows the President to use military forces when they determine that unlawful obstructions, combinations, or assemblages, or rebellions against the authority of the United States make it impracticable to enforce US laws.

President Trump CAN activate the National Guard
1) for invasion [called by Bass and Newsom],
2) for riots against America [called by Bass and Newsom],
and 3) for times the CIC is losing power
[called for by Bass and Newsom].

It does not matter that Bass and Newsom took out
fire insurance before they started these fires/riots.
It might have made them billions but will not protect them.

Dershowitz agrees with what I have already predicted and posted on FR. Our judiciary is a joke that a bunch of political judges can knowingly frustrate legitimate presidential authority. Something must be done to curb these leftists dogs.

I am surprised that a district judge hasn’t already issued and injunction about the National Guard and Marines deployment. Maybe the liberal judges are waiting to see who gets the short straw to issue an idiotic opinion on this.

This is a no brainer. The judiciary often shares space in federal buildings with other departments. I suspect many of the LA Federal judges, even the most liberal ones are quietly relieved the NG was called out.

If a President can federalize the National Guard so a kid can attend public school, what’s going on in LA far exceeds that threshold.

I don’t think any relevant legal language requires the terms “full-on” or “full-blown” be applicable while anything less would fall short of being able to be authorized.

Yes. That card can still be played if POTUS deems it necessary. My issue was with Derkowvitz.
Why is he making the point that it is not an insurrection?

From what I’ve seen, the mess, as he calls it, is all on the state/city side. Based on everything I have seen, the federal buildings are secure. At worst, maybe some graffiti on the sidewalk or sides. Meanwhile, multiple stores have been looted, I would say at least a dozen cars lit on fire, garbage lit on fire in the streets, freeways blocked, etc.
