If someone represents a danger to himself or others, then what should be done with them? If they have guns, doesn’t that heighten the danger? What’s the remedy here? I feel that waiting until something bad really happens does not represent an answer to the problem.
I’ve known people who have attempted suicide. They get put in the loony bin for 30 days and release if it’s believed the threat has passed.
Red Flag laws consider the case of those being a bona-fide threat to others and guns can be seized without a hearing involving the defendant. So in the threat to others case, the comparable treatment would be to hold them in jail until it’s believed the threat has passed.
This is the oxymoron of Red Flag laws - if they are not truly a danger, then there is no need to take the guns. If they are, they need to be locked up.
