Vivek is an NBC, born to parents legally within the United States and therefore subject to its jurisdiction, which was the meaning of the phrase at the time it was written, and is a matter that has been adjudicated multiple times.

What has not been adjudicated is children born to parents not legally within the US and that is now likely going to be.

The 14th Amendment IS a glorified naturalization statute.

The 14th Amendment IS NOT an extension of the Constitutionally-incorporated concept of natural Born citizen.

Individuals forced to point to the 14th Amendment to prove U.S. citizenship ARE NOT demonstrating personal participation in the natural Born citizen franchise formally recognized and established in 1788 (9th sovereign ratification). They ARE demonstrating personal participation in the later-arriving franchise of what This Guy would describe as Constitutional naturalization. Once again—a Constitutional extension of the concept of naturalization.

Congress has the Constitution power to regulate naturalization, including naturalization based at least in part on birth circumstances. Some don’t know this, but when the late Arizona senator John McCain was born in or adjacent to the Panama Canal Zone, no U.S. statute existed that had been passed pursuant to Congress’ Constitutional power to “establish an uniform rule of Naturalization”, but only some few years afterward, when Congress squarely looked at the situation, and chose to act. Otherwise, John McCain would not have later been recognized, or even legally recognizable, as a U.S. citizen. This despite having two U.S. citizen parents, one of whom was a high-ranking officer in the U.S. Navy.

Do you get it? Congress has to act under its Naturalization power, it then acts under its Naturalization power, and ***whamo***—individuals born under specific circumstances are retroactively recognized as citizens. Naturalized citizens!!
