Plus several of these say they were signed in Washington when he was out of the country.

Interesting article, but not all that relevant to the pardons at issue. Why? Because the author references the “presentation clause” in Article I, § 7 of the U.S. Constitution, which refers only to the presentation of legislative bills, orders, resolutions, or votes to the POTUS that require the approval of both the POTUS and the House and/or Senate. It does not refer to actions that are exclusively within the power and authority of the POTUS, such as pardons and executive orders.

In my opinion, the POTUS has the absolute power to authorize the use of electronic signatures with respect to actions that are purely executive (congressional approval not required), unless otherwise prohibited by the Constitution or statute — there is no such prohibition. The only issue is whether there is a paper trail that establishes that Biden approved the pardons and the use of his electronic signature to formalize his approval - something we will probably never know for sure.

Autopen signatures have stood up for decades. This is a non-issue.


Six of the pardons were “signed” in DC while Creepy Joe vacationed in St Crois. A rational person would admit they weren’t actually pardoned by Biden.

A rational person would recognize that there’s no functional legal difference between telling somebody in the office to push the button and a hand signature. I signed all kinds of crap online for a mortgage, I have no idea where the “official record” says those signature happened. And it doesn’t matter.

The only way that this would matter would be if Joe Biden made a sworn statement that he did not approve of a particular document to be signed and that it was a forgery. Otherwise, any document with his signature affixed during his time in office is legal. There are thousands of documents that require any President’s signature, and he doesn’t have the time nor pens to do them all. Actual signatures are only done for ceremonial purposes.

What if he was “present” i.e. in the room, but let the autopen do the work? Enough to make those signatures legal?

Just set Biden down and see if he can remember the names of the people he pardoned. I think it would be a repeat of the Robert Mueller interview when he couldn’t answer questions.
