Trump Organization sues Capital One for closing bank accounts after Jan. 6 attack on US Capitol

MIAMI (AP) — A company owned by President Donald Trump sued Capital One on Friday, claiming the bank unjustifiably terminated over 300 of the Trump Organization’s accounts without cause in 2021, shortly after the Jan. 6 attack on the U.S. Capitol.

The suit was filed by the Donald J. Trump Revocable Trust and Eric Trump in Miami-Dade Circuit Court.

The Trump Organization claims the decision by Capital One to close the accounts was an attack on free speech and free enterprise. The suit also claims the decision was a response to Trump’s political views.

“Capital One has not and does not close customer accounts for political reasons,” the company said in a statement.

Agree that it is probably legal—but there may be legitimate civil liability claims depending on the fine print in the agreements.

If the bank’s actions were illegal, then the matter would be being pursued by criminal charges rather than by lawsuit.

Legal or not, Capitol One’s actions were likely not instigated on their own. My bet is that there was pressure from some government agency being placed on them to do this. If this law suit causes Capitol One to reveal any such coercion, that alone would make it worthwhile.

That would also make it criminal, since acting to wreck a political opponents accounts on behalf of a corrupt regime is a civil rights violation.

I’m not a lawyer, but yes, I agree that it would likely be criminal for any government employee(s) to pressured a business to discriminate against one of its customers based on political considerations. Whether Capitol One itself would be criminally liable, I’m not sure.
