Musk Calls for Impeachment of Obama-Appointed Judge Who Blocked DOGE Access at Treasury
Zero Hedge via Freer Report ^ | 02/10/2025 | Tyler Durden

Elon Musk has called for the impeachment of an Obama-appointed judge who barred DOGE and the Treasury Secretary from accessing payment systems at the US Treasury.

On Friday night, Democrats went ‘judge shopping’ to ask that Musk’s team be stopped from accessing Treasury systems, knowing that instead of receiving a judge by random selection, the only available judge would be Paul Engelmayer – who held an ex-parte hearing without DOJ lawyers. Engelmayer did not cite any case law or precedent for his ruling, which many have criticized for vast overreach.

Other than Trump and Elon Musk, who else in the GOP demanding this judge be disbarred and charged?

I’ve been saying this for years. We went from judges who followed the Constitution to judicial overreach to judicial activism to outright judicial tyranny. It needs to end now
and Congress needs to use the impeachment process to achieve this.

Yeah, if this is going to keep happening with these radical judges, Trump is going to need a mechanism or system in place to squash em. Quick action, or just ignore them.

What are they going to do, call in the muscle? Trump is the Muscle.

It won’t hold up and the Democrats know it. It is a stalling tactic, and I predict that it will be resolved by the end of the week. Trump has been attacked by so many and from so many directions, he knows how the system works and I am sure he saw this coming.

Welcome to the party, pal!!!
I have been calling for the house to fulfil it’s constitutional duties and impeach rogue judges since 2004!

Hey Hey...

"What are they going to do, call in the muscle? Trump is the Muscle."

Exactly. Do they think Trump's DOJ is going to go after Musk and DOGE?

Both House and Senate must vote.

They are too corrupt to do that.

Repubs are on the take from Deep State too. Big time, especially Senators.

Judges have way too much power. In my mind, in order to overturn a president should require Congress or the Supreme Court. There is only one reason for not having transparency with the treasury. They all have their hands in the trough.

“...it will be resolved by the end of the week.”

It needs to be resolved by the federal Article III judges ENTIRELY BUTTING OUT.

Like, Emily Litella-style, “Never mind!”, butting out!

The judiciary has assumed power. Legislators and executives are too busy preening themselves to do the actual work required of them. Being lawyers, the judges are only too happy to barge in.

Congress needs to use the impeachment process to achieve this.

Removing a judge requires 1/2 House to impeach and 2/3 Senate to remove.

Have you been watching recent votes in the House and Senate - they are virtually all along party lines. We have too many in Congress that vote party line and could care less about the Constitution, truth or what's right or wrong. Democrats and RINOs will blunt any attempt to remove these dictators in black robes.

Choices: (1) Ignore the dictates of these judges - then you will have the democrat media screaming dictatorship. (2) Appeals process - takes a long time. (3) Impeach - Even if Johnson can get the R members to impeach, getting 2/3 Senate to remove is virtually an impossibility.

The Treasury probably pays out based on its own records (IRS, debt, payroll, procurement) and payment orders from agencies.

The DOGE people can get the payment orders from agencies. The payment orders would have the appropriation information, the payees and the amounts. These might come in the form of DVDs or hard drives delivered by courier or armored truck.

The DOGE people can probably get from the Treasury via FOIA whatever might be given to Congress.

A Congressional committee can request the Treasury provide the information.

The agency payments can be delayed until 24 hours after receipt by Congress of Congressionally requested information.

The DOGE people can probably get from the Treasury via FOIA whatever might be given to Treasury pre-payment auditors. The possibility that someone at an agency might slip in a $200 million payment order to an ‘Islamic charity’ needs to be guarded against.

The Treasury might still pay by mailed check. The checks can be held by the Treasury until two hours after the DOGE people have been given all possible information consistent with the judge’s order.

Yes, or they can rightfully just ignore the judge.

The SCOTUS made it very clear a long time ago that Courts do not have the power to order the Executive Branch to act or not act when the branch is acting within it’s discretional Constitutional and legal authority.

Pres Trump unfortunately is on his own- sure, “republican senators” all, sucked up to him when he ran, but how many are supporting him by calling for the impeachment of the judge (or for a judicial review of the possible il,ehality of the judge’s order at the very least?) Haven’t heard of any yet. They want pres Trump to give them fed funds, but aren’t willing to stick up for him
