Most of the groups putting together court challenges probably receive federal money directly or indirectly.

It is a race to cut off their funding and stop them first.

I don’t disagree they will try, but on what basis can the challenge occur? For the sake of argument, suppose Trump reduces an executive agency to 25% of its former size. A portion of congressional funding goes unused for this budget year, or is used for severance pay (by the way, do we even have an approved budget given the never ending CR’s to avoid a shutdown?).

What can a court do about this? Is the executive required to never reduce the scope of an agency, I.e. government can only grow in size and never be reduced? That is plainly not the founders’ intent. I have no idea on what basis a lawsuit could even occur.

How many of their favorite judges are guilty of receiving skimmed fed money? Hopefully, that will make it harder for them to sue. I would have expected more court cases with judges ruling Trump to pause by now. I think there was only one case so far.

The big issue of our day is whether these “independent” agencies are constitutional...

Even though Congress may have declared USAID as "independent," it also created a conflict when it put the Director of USAID "under the direct authority and foreign policy guidance of the Secretary of State."

See 22 USC Ch. 74: FOREIGN AFFAIRS AGENCIES CONSOLIDATION §6592. Administrator of AID reporting to Secretary of State:

The Administrator of the Agency for International Development, appointed pursuant to section 2384(a) of this title, shall report to and be under the direct authority and foreign policy guidance of the Secretary of State.

Also §6563. Status of AID:

Unless abolished pursuant to the reorganization plan submitted under section 6601 of this title, and except as provided in section 6562 of this title, there is within the Executive branch of Government the United States Agency for International Development as an entity described in section 104 of title 5.

5 USC 104: Independent establishment:

For the purpose of this title, "independent establishment" means-

(1) an establishment in the executive branch (other than the United States Postal Service or the Postal Regulatory Commission) which is not an Executive department, military department, Government corporation, or part thereof, or part of an independent establishment; and

(2) the Government Accountability Office.

USAID cannot be both independent AND under the direct authority of the Secretary of State's policy guidance. If SCOTUS has to decide, I think it will side with the Secretary of State. Separation of Powers would suggest that Congress cannot cut off parts of the Executive Branch from the President's contro any more than the President can cut off committees from the control of Congress.
