A mother who allegedly couldn’t be bothered to look up from her phone while her 3-year-old son drowned nearby at a Texas waterpark has been indicted nearly two years later.
Jessica Weaver, 35, is charged in connection with the death of her son, Anthony Malave, who drowned in May 2023 during a soft opening at the new Camp Cohen Water Park in El Paso.
One of 18 lifeguards working at the park pulled the unconscious boy out of a 4-foot-deep section of the pool. He was rushed to the hospital where he died, police said.
Weaver was glued to her phone while the boy splashed around in the pool without a life jacket, witnesses told police, according to documents obtained by People magazine.

BTW, I see this kind of stuff at the grocery store. Moms on their phones and the kid runs away for her and she does not notice fast enough.

Yea, what good are 18 lifeguards?
There’s a gym in a shopping plaza near me. Folks who park in the lot always stop and look both ways before crossing the lane and going into a store.
Except for young folks heading towards the gym. They are usually on their phones. They never look. Even the few ones who are not on a phone never look.
It’s really odd. Young person + gym membership = invincible (?)

Unfortunately, while the mom might get some sort of punishment, She may well win her lawsuit or get a good settlement. The missing video will be damning against the city. The jury won’t like it and they will wonder where the life guards were and why was there no extra diligence on the part of the guards.
Two sides here and they were both in the wrong.
Horrible! I was not raised as a swimmer, so I was extremely cautious when my boys were in the water. So he was totally on his own! So sad.
SHE’S suing the park and city for not watching her child. Watch her defense be cell phone or social media addiction. (It IS a real diagnosis now.)
Yep. I don’t trust them either. I am always counting up to three to be sure I know where all the grandkids are.

The same thing happened at a sand pool on a military base nearby about 15 years ago.
The sand pool was shut down, filled in and turned into a softball field.
No kidding. It’s kind of stressful watching while they swim. And we have a pool, so we really have to keep an eye on them.
Drowning is a very quiet thing. There is no screaming and very little if any splashing. There’s a YouTube channel that has camera coverage at pools showing rescues. Most people are drowning within arm’s reach of another person who is oblivious to the fact that they are drowning. Most of these people are parents who simply don’t recognize it.
