No specific to this case, but this is one of the big problems with 'the law' in the US. You can get entirely screwed by unscrupulous people, or have false charges against you (like Trump, General Flynn, and many others) and have to pay a fortune to get good representation. And, you are at the mercy of biased and unknowledgeable juries.
On the other hand, you can have a fender bender, complain of neck pain, wear a cervical collar though you don't need it, and make a windfall.

Lawyers love these soft tissue injuries. They do not show up on X-rays. So they cannot be proven or disproven. The “proof” is what the jury hears from the claimant. About his pain and suffering.
You want to claim broken bones? These do show on x-rays.
Years ago a kid pulled out in front of me. Didn’t look both ways at the stop sign. I was on a 40 mph road going 45. This was just before seat belt became mandatory and of course my younger self wasn’t wearing one. I got out of the car and started walking. Witnesses at a house on the corner came and brought me over to their yard to wait for the cops/ambulance. I suppose I should have stayed in the vehicle and my neck immobilized. They treated me dismissively at the hospital (I was thinking at the time it was probably because the other driver was in pretty bad shape and after all “I” had hit “him” (never mind there was no way to avoid it) but was eventually diagnosed with a cervical sprain/strain. I was young and poor so after three sessions of physical therapy when the place wanted some money I told them the person’s insurance company States they will pay when they get the final bill but that wasn’t good enough for those greedy people so I stopped therapy. Neck has never been the same. In older years now, nerve issues are part of it.
