The issue is not the First Amendment.
The issue is whether the pollster and/or the newspaper were paid to lie, then knowingly and maliciously lied, and then failed to disclose it in a timely manner.
If that lie harmed anyone those harmed may have a cause of civil action.

Published in “news section” of fake news media does not make it news.
This was a clearly planned voter suppression effort by Ann Selzer and the Harris campaign to suppress voter turn out of Trump voters.
Unfortunately for them it failed miserably.
Selzer and Des Moines Register who have now been officially sued by President Trump, will get taken apart in court.
