The family of a woman who died after falling through an uncovered manhole in Dallas is filing a lawsuit against the city, asking for $100 million. Her body was found three days later at a sewage plant

Best practices are to tack weld the manhole covers in place. A maintenance crew needing access spends two minutes to cut the welds and the same to tack it back after finishing their work. They are frequently stolen for scrap value by petty criminals. They fetch about $20 each as scrap.

I'm reminded of the Fort Worth Water Gardens drownings over a decade ago. Black family went swimming where it was clearly prohibited and two of them drowned. The family only got $750k as a settlement, which shouldn't have been granted at all since the family was so careless.

The Water Gardens had existed since the mid-70's without a single serious incident. It has always been a haven for drunk homeless vagrants and even THEY managed to keep from getting killed by their own stupidity.
The Active Pool pictured now features ugly railings on the stepping stones which completely ruins the aesthetics.

This is one of the rare practices that Europe gets right. If you fall down and get hurt, that's on you. They don't have a litigation problem.

Third option - some vandal removed the manhole cover.
I would think that one should have to prove that the city knew, or should have known, it was missing.

Sounds like she fell into the sewer and her body was carried to the sewage plant where it was found. If so, that’s awful.

I remember the Water Garden incident. Local hotel had closed its pool because of the large number of a certain group of visitors to the area.
As I recall, the location was featured in Logan’s Run.

Yep, Fort Worth’s claim to fame.
The Active Pool is scary, by design. I’ve walked down to the bottom many times. The water cascading around you makes you feel very vulnerable, keeping you highly alert.
Blacks and water just don’t mix. But you can’t ban them from such attractions because “discrimination.”

They are frequently stolen for scrap value by petty criminals. They fetch about $20 each as scrap. Believe it or not, sometimes they also occasionally get stolen by people for whom these covers are collectors items. Some of the older covers in older cities, especially, were very ornately designed and are unique period pieces.

The city liability insurer will modify the amount. Tyre Nichols civil lawsuit against Memphis is the same, $100 Million. Yes, that will break the city, it’s bonds, its operations. $100 million seems to be the tipping point number.
