I know what term they used. 'Enemy' is not a category of combatant in LOAC. 'Legal' which may or not be an enemy as it describes the good guys as well. 'Illegal' which you don't want to be, always a bad guy, not necessarily from the State with which you are warring. 'Non-combatant' which is self explanatory. Rewrites have used different terms to describe 'legal', 'illegal' and even 'combatant'. But they are the only three categories in LOAC or LoW.
I know Kavnaugh knows the difference or should since he graduated from law school but he may have no experience in its application. Lindsay? Smoke blower.
