A verdict came down in the murder trial of a Capitola woman who was killed by her boyfriend back in Dec. 2023.
A former San Francisco rock band member, Theobald "Theo" Lengyel ,54, was found guilty in the murder of Alice “Alyx” Herrmann. He was found guilty of first-degree murder.
Prosecutors had alleged Lengyel strangled his then-girlfriend Alice Herrmann, 61, and then buried her body in a Berkeley park.
The former tech worker and saxophonist in funk-metal band Mr. Bungle has not denied killing Herrmann but his lawyers say the circumstances do not rise to the category of first-degree murder; Lengyel pleaded not guilty to all charges.

The three-hour recording was only discovered after the trial began, and it’s unclear whether Herrmann intentionally recorded it in her Capitola home. The recording reportedly starts with Lengyel playing piano before growing angry at Herrmann when she doesn’t agree to go out with him to play pool.
“I could mash your f—king brain,” Lengyel can reportedly be heard saying.
“When you drink, this s—t happens, we fight,” Herrmann reportedly responds.

According to prosecutors, while strangling Herrmann, Lengyel can be heard saying, “You’re gonna f—king die right now. Are you ready?”
Herrmann reportedly could then be heard pleading for her life, gasping for air and saying “stop it” 53 times.
Herrmann was last seen in Santa Cruz at a rowing event on Dec. 3. On Dec. 4, she remotely logged online for work, according to the Capitola Police Department. An investigation began on Dec. 12, with police quickly identifying the disappearance as suspicious.
Her car was found in front of her boyfriend's home in El Cerrito, according to El Cerrito Police.
According to Herrmann’s brother, who says he is not close to Lengyel, the couple were in a long-term relationship.
Herrmann's body was found in the Berkeley in the wooded area within the Tilden Regional Park. The body has since been positively identified as Herrmann.
Herrmann was an accomplished professor with a Ph.D. in neuroscience and a love of the outdoors, her friend Betsy Marvit previously told SFGATE.
“She was a soft-spoken lover of life,” Marvit said. “With a strong connection to the sea, to her daughter, and to the many friends who loved her very much.”
He is scheduled to be sentenced on Nov. 7.
It would have been a better decision to just break up with her and pick up women backstage...

Alcohol can make some people crazy. He’s probably already crazy though. He wanted to go play pool instead of playing a duet with his girlfriend.
Ph. D in neuroscience doesn’t know enough to get the H away from an angry drunk man? She probably thought she could reform him by pointing out his behaviour to him...
Didn’t deserve to get killed...but the signs were there..hope he hangs, fries, or is asphyiated ....
So...”Theo” & “Alyx”...maybe too many quote marks are unhealthy for successful love.
