Politics hath no fury like a prosecutor scorned, and it appears the American electorate won’t be allowed to forget it. That’s the best read of special counsel Jack Smith’s newly unsealed filing in his criminal case against Donald Trump. Congratulations, Attorney General Merrick Garland: You’ve got your own 2024 “election interference” story line.
Mr. Smith filed the 165-page brief last week, his latest response to an embarrassing defeat at the Supreme Court in July. The justices rapped him for ignoring a weighty question in his Jan. 6 indictment, ruling that a president is entitled to immunity for exercising “core constitutional powers.” That decision requires a pretrial proceeding in which the trial judge sifts which of the allegedly criminal acts count as official, and ultimately ended any prospect of a trial before the election. A sober litigator would have stepped back, allowed the voters to render their judgment on Mr. Trump and his bad behavior, and regroup in November.
Here’s what Mr. Smith did instead. He rushed to file a superseding indictment in August that alleged the same four crimes, taking a minuscule view of core constitutional powers. He then requested the trial judge allow him to file an “oversized” brief—up to 180 pages—laying out the government’s arguments against immunity, and asking her to unseal it. Judge Tanya Chutkan granted the requests, ignoring the Trump legal team’s opposition to a brief that was “quadruple the standard page limits” and that allowed the prosecution “to proffer their untested and biased views to the Court and the public as if they are conclusive.” That brief was made public on Wednesday, 34 days before the election.
Which is the point. You don’t have to be a cynic to suspect Mr. Smith of brass-knuckle politicking. He knows that if Mr. Trump wins in November,

the deeper question is, and ALWAYS has been, nWHY are the deep state players so damn scared of President Donald J Trump becoming President again when they can cut him off at the knees again...just like last time?

I thought it was determined his appointment as special counsel was declared illegitimate. I really can’t see this guy enjoying a long and peaceful retirement.
Jack Smith illegally appointed for the job to make sure laws are one sided media and D.C. mum.
Clearly this release was political, however I don’t think its going to have much impact.
Two reasons:
First, if you believe January 6 was an “insurrection” and was a big deal to you, you are already voting Democrat.
and Second:
There is too much other serious crap going on that is preventing this from being the top story. Hurricans, War in the middle east, etc. Don’t get me wrong they will keep trying to push it to keep it in the headlines, but competing with those sorts of things it is going to come up short.
We will see, but by and large this just looks like more hack nonsense... another “Trump dove at the steering wheel” nonsense.
Will be consumed rabidly by the Trump hating base, pushed hard to try to harm him, but largely be a ho hum nothing burger for most everyone else.
If you don’t hate Trump over Jan 6 by this point, its hard to see that this is going to sway your opinion against him.
We shall see.

The other case he's handling still has the outstanding question regarding his unlawful appointment as Special Persecutor by Garland.

Uh, maybe I misremembered, but wasn’t jack’s position deemed to be not valid?
Jack was found by Judge Cannon in FL to not exist.
This current apparition of Jack is in DC in the court of Judge Chutkan, who would eat Trump’s raw liver with a knife and fork if she could.
This just released file is more gossip of the type the girl did on Trump attacking his driver in the limo.
If he is not a properly appointed special prosecutor, by the definition of the statute, then this isn’t a proper filling and it’s nothing more than DOJ and Democratic party using government illegally to attack political opposition.
That should be determined after the election with military courts.

The reality is, thinking people stopped paying attention to Jack Smith’s actions after about the third Bi+ch-slap he received from the courts.
I would venture to guess that the ONLY people reading Jackoff’s latest ‘legal’ filings are the half-sane legal circles within the DC beltway.
The rest of the nation has moved on and has rendered judgement on Jack Smith’s absurd conduct.

Yet another case that will need to be remedied by SCOTUS.
Whenever I see a picture of that guy I am reminded of when I thought I had hemorrhoids and decided to check with a mirror.

Hell it couldn’t be more obvious. The SOB is furiously trying to dent Trump’s vote. His own life depends on it, because when Trump gets in, he’s cooked.
This will be red meat for the die-hard Trump-haters who were never going to vote for him anyway.
Everyone else sees this as beating a dead horse - it won’t move the needle.
