On the one hand I agree with him in principle that the 10th amendment clearly makes a federal ban on abortion unconstitutional. Except, that since I consider a human fetus to be a human being with human rights, I disagree with the notion that any "new" laws are needed to protect human life in the first place.

My position is that we should simply clarify (however and wherever it is most appropriate) that all human beings enjoy the same human rights as enshrined in the Constitution and Bill of Rights/amendments. No new laws should be required to assert this status, as doing so gives in to the falsehood of the pro-abortion crowd that some humans are not "persons" (the same argument made by Nazis and slave owners) with human rights. Just require that law enforcement protect the rights of unborn human beings the same as everyone else.
