Because Smith was never legally appointed, does he have personal legal liability for his actions?

If he was not legally appointed; it should follow that he doesn’t have qualified immunity.

The question it seems to me is who exactly appointed Jackie. If it wasn’t legal then by definition the appointment was illegal. Who was it that broke the law, hmmmm?

I would argue he does.

Heck, he pretended to be a peace officer, when he was not (as US attorney).

Arrest him and put him in Florida prison.
