That much is certain and most people even pro choice people accept that it’s somewhere from single cell to can survive if mom dies this second that states have to define it’s no where in federal law or powers. States already decide their own homicide laws so the precedence is there. I think most people would say only before viability at the latest that’s a winning position. The single cell be it IVF embryos looking at you Alabama or first day of ovulation fringe group is not a winnable fight in modern America. 12-15 weeks is penalty of time to figure out ok it’s not a chemical pregnancy and what does the social situation of the person look like then make a choice with them and their physician. As was pointed out equal protection under the 14th would apply once that setting point is legislated for homicide or accidental deaths too.
