It didn't receive much attention at first in the 'Immunity' decision but Justice Clarence Thomas wrote a separate statement of judgement along with the majority... a rather detailed summary of how he might decide a case against the constitutionality of the appointment of Jack Smith as 'Jack the president slayer' (my phrasing).
Judge Cannon in south Florida has indicated that she is studying a motion by the defense questioning the constitutionality of Jack Smith's appointment. How timely for Justice Thomas' momentary diversionary documentary! He has expressed interest in the issue previously and is now entering a standard in a possible jousting match.

Of course there is always the possibility that the Dem/DS growing totalitarian autocracy will just wipe the whole issue off of the table, disband the Supreme Court and arrest DJT and all MAGA Republicans, hoping to scare away any popular dissent. 🤷 There are rumors of such.
