They can certainly turn it down if you ask them in advance whether they want it.

President Trump pardoned Gen.Flynn, and Flynn accepted it, no doubt gladly, although he was completely innocent and the DOJ had already dropped the charges, but the scumbag judge Sullivan refused to drop the case.
