I believe this has to do with the insurrection act Trump signed. And the insurrection was by congress rejecting the alternate slates of electors presented to Pence. I believe that was the real insurrection, complete with the fencing off of Congress. I believe the military has been the authority since then. Either way we will find out soon.

I don’t think VP Pence ever got the alternate slate of electors.
I know he signed an agreement with Mitch(I saw the document but didn’t save it and now I can’t find it) that he wouldn’t open them if received.
Turns out, Archives and Congress each received copies. Archives never acknowledged them. Pence never saw them as neither passed them on to Pence.
