Fox News host Sean Hannity called on Arizona Democrats to nix an abortion ban that was reinstated by the state Supreme Court this week.
On Tuesday, the high court reinstated a law that traces back to 1864 and was subsequently codified in 1901. It bans nearly all abortions except those that are needed to save the life of the mother. The decision supersedes Arizona’s 15-week abortion ban, though the state’s Democratic attorney general has said she will not enforce the “draconian” measure.
The decision dropped a day after former President Donald Trump – who said it goes too far – came out against a nationwide ban on abortion in a move that disappointed many anti-abortion advocates but was also praised as politically savvy. Since the U.S. Supreme Court overturned Roe v. Wade and the constitutional right to abortion in 2022, Democrats have leaned into the issue with great success.
Hannity, who opposes abortion, addressed the decision on Wednesday night and called on Democrats to legislate the ban out of existence:
"And the people on the left are so desperate attacking Trump now for an Arizona Supreme Court ruling that upholds what is a Civil War-era law banning abortion. This will be fixed in the next week or two. Let not your heart be troubled. I can pretty much assure that will happen.
"Trump opposes the law and this ruling… And you know what? Arizona’s governor is a Democrat. The state’s attorney general is a Democrat. The state legislature is almost evenly divided. If Democrats– you want to get rid of the law, well, you have a chance right now to get rid of it. And I would advise you, get rid of it!
"They would rather use it as a political tool ahead of November."
Currently, Republicans control each chamber of Arizona’s legislature by two seats. Democrats attempted to repeal the measure on Wednesday but were blocked by Republicans.

The whole idea behind dumping Roe was to take court out of making social decisions and allowing the PEOPLE and States to make decisions on things like abortion.

I think the 19th century law completely banned abortion. The 21st century law banned it after 6 weeks (or 12 weeks?) with certain exceptions. So the INTENT of the 21st century law was to only allow abortion during those initial weeks. I guess the new law was simply poorly crafted so that the total ban still stands.
FWIW here in MI we had the same thing, a complete abortion ban from 1931 defaulted from the SCOTUS ruling. So the pro-abortion no limits crowd went ballistic in a very short time and gathered enough signatures to get it on the ballot in the fall.
And of course the female turnout was especially high and now abortion is enshrined in the state constitution. Other bad news is that our state legislature and state senate turned blue for the first time in decades because of the extra voters.
The only fragment of good news is that this proposal was a one-shot deal that brought many to the polls who would not vote anyway, majority female. The GenZ males can’t stand their female counterpoints as we all know about and that generation largely won’t turn out for Xiden.
Every Republican on the AZ Supreme Court is of the McStain faction. They made this ruling at this time to help the commie running against Kari Lake. This is the same Supreme Court that has no interest in ruling on election integrity issues such as signature verification for mail-in ballots, machines that only break down in Republican districts, and mail-ins arriving at polling places with the container seals broken.

I never said conservatives don’t respect the Constitution. I said that conservative ideologies don’t. There was one person in this thread that argued for a national law on abortion. That’s not constitutional, therefore disrespectful of the Constitution.
