Texas observes a version of what is commonly known as the Fleeing Felon Rule. The moral of the story is: don't come onto someone's property at night and try to steal stuff and, if you get caught, don't try to run.

Declare the act of fleeing law enforcement a felony and shoot the fleeing felon. Works for me!

We shall see, I got no dog in this fight, but when the shooter is the one actively creating a confrontation, I find it difficult to believe a stand your ground/thought he had a gun argument is going to work, even in Texas.
