That’s the only hope they have as a DC jury will acquit.
Not a criminal proceeding. Lower threshold for the plaintiff. They don’t have the prove beyond a reasonable doubt, just a preponderance of the evidence.
Where this gets sticky for the defense is the shooting report was never made public. I believe the Capital Police only released the result. Now they will have to give the plaintiffs the entire report to include interviews, forensics, and initial witness statements.
It could also open the door to prior planning by not only the Capital Police (and Pelosi’s involvement) relevant video prior to and just after, and the officer’s propensity to mis-handle firearms.
That’s why I think they won’t take the risk of discovery and offer a sizable settlement.
The lawsuit was filed in CA...I guess Judicial Watch does not want to deal with DC jury...But, I think Justice Department would probably succeed in moving the case to DC...After all, the shooting happened in DC...
DC jury...Not generally sympathetic to police...In my opinion...It is also very likely that DC jury is not very pro-Trump...
I think that it will be very hard for Judicial Watch to convince the DC jury to act in favor of Aaron Babbitt...
