I don’t believe that being let out pending a trial should be determined by whether you can afford to pay your way out.
Either you are a flight risk or too dangerous to be let out, in which case you should be kept in custody
or, you can be safely let out, in which case it shouldn’t matter whether you can afford to pay your way out.
Way back in the 70s, during the last crime wave in NYC, there was a judge called “turn em loose Bruce”. He considered the arrest of blacks a racist act. He was severely criticized at the time for his soft on crime rulings. Now all the NY judges are named Bruce.
