My strategy would be for defense lawyer to say it was a Diet Coke, not a regular Coke, so reduced charge.

That’s quite possible. I was an armed security guard years ago. This would be the kind of video used in training to discuss where that fine line begins and ends.

Fortunately for the thrower, he did so after the alleged perp got into a physical altercation with security. You are allowed to use equal force or one “notch” above what the alleged perp is using. But it is truly a gray area. Lots of case law.

Further, the thrower deserves a reward but might be at risk of being fired under the policies of many large corporations. It has ramifications on the cost of insurance.

Sad state when criminals are considered victims and victims are considered victims. But kudos to the thrower anyway. It’s how it SHOULD be done.

The way I see it the perp was assaulting another employee with a shopping cart. The employee who threw the bottle was defending him. That’s my story and I am sticking to it!
