I object to using the honorific "honorable" to describe a judge who isn't. In cases like this, when a judge refuses to issue a ruling to delay a decision which can be appealed, the writ of procedendo may be issued by a superior court to compel the matter. Such writs are not commonly granted by appellate courts, even when warranted, and most attorneys don't want to annoy the judge, because they will have other cases before that same judge.
