Unobtainable by FOIA does not mean unobtainable by subpoena as evidence in a court case. And once they are evidence in a court case, they become public records, which are obtainable by FOIA.
This report does smell, and perhaps it is a hoax, but I don’t trust ANY of the parties involved. Pelosi, Epps, FBI, Snopes, AP.
I’ll believe it’s a hoax when debunked by credible sources. Because it hasn’t been picked up by anyone in the past week implies it’s a hoax, BUT it’s been an incredibly newsy week and this may have escaped attention, as it has evaded my attention and other posters within.
It needs attention and examination.

Well, someone had enough time to construct two (non-working but apparently convincing) “bombs” to plant at the DNC and RNC the night before Jan. 6.
Yeah, if Pelosi DID speak directly to Epps, then it would be evidence that Epps was NOT an intelligence or counterintelligence asset, because if he was, that wouldn’t ever have happened, for reasons of plausible deniability, compartmentalization, etc.
I suppose he could still be some amateur contracted by other amateurs, but it would weigh very very heavily against any notion that he worked for one of the 3-letter organizations.
As for the claims there is "no evidence" that he is a gov't stooge......The simple fact that he has not been arrested in spite of the video evidence, IS evidence that he is a gov't stooge!!!
Get his records and look for Pelosi's ###!!!
If Epps is not a govt. agent or employee, then No, FOIA does not apply to him. Private people and entities must be subpoenaed for records in accordance with Discovery statutes. The way to do it is to subpoena him for all phone records from that timeframe, and also subpoena his phone service carrier for the same thing.
To clarify, the fact checks claim Epps communicated with “Pelosi’s office”, which isn’t quite the same as speaking to Pelosi, but does imply some coordination.
Well, anyone could call up Pelosi’s office and get on the horn with some assistant, I suppose.
But again, if Epps was a “professional”, it doesn’t seem like something that would ever happen.
“Anyone” and everyone has or could call her office, but Epps isn’t “anyone.”
Epps is a questionable figure in one of the greatest frauds perpetrated on America.

Certainly, but what I’m getting at is that, if we assume the allegation is true, and he did call Pelosi’s office, then what are the implications of that?
A superficial analysis might be: “hey, we got evidence of collusion!”
But a more perceptive analysis would result in: “well, Epps can’t be working for the FBI (or insert agency here) if he was dumb enough to call Pelosi’s office directly”
FOIA does not apply to the Legislative branch.
Depends on who he called. If he called someone or was called by someone in the Legislative branch, any such records are not subject to FOIA.

This maybe true but how about the calls, texts or emails between Pelosi and the head of the Capital Police?
She is admitting she called for troops while the rioting was going on!
The Chief of The Capitol police told Tucker Carlson in an interview both he and Donald Trump called for thousands of National Guard troops days before jan6th and was turned down by Pelosi
WHAT? I thought it was Trump who asked for 10,000 troops?? Never heard about phone calls.
