He was doing his job. I watch multiple similar reports daily and unless the officer was not on duty, he is covered by qualified immunity.
Even in those cases where cops raid the wrong house and kills an innocent they are generally covered by immunity.

Is it the police's job to stalk people that give them the finger and then use pretext as probable cause to stop them and beat their azz? NOPE. I've actually litigated similar situations against state and local govt. employees. In one case the employees were sued in both their official and personal capacities. Official capacity means the Govt is responsible, individual capacity means they're personally responsible. Boy were they pissed when the judge said their motions to dismiss the suit against them in their personal capacity were denied. Just because they're at work on duty and wearing the uniform, they are not always covered by qualified immunity.
