“This is the kind of case that should not be allowed in court”

I agree however, frivolous litigation got let off the chain way back when one idiot spilled hot coffee on themselves from a fast food drive through and successfully sued....AND this is California.......it will go through the motions and more than likely succeed.

one idiot spilled hot coffee on themselves from a fast food drive through and successfully sued.

Have you actually read about that case? The coffee was over 180F. I don’t care WHO you are, that’s too hot.

Quote:

“The plaintiff, Stella Liebeck (1912–2004), a 79-year-old woman, suffered third-degree burns in her pelvic region when she accidentally spilled coffee in her lap after purchasing it from a McDonald’s restaurant. She was hospitalized for eight days while undergoing skin grafting, followed by two years of medical treatment. Liebeck sought to settle with McDonald’s for $20,000 to cover her medical expenses. When McDonald’s refused, Liebeck’s attorney filed suit in the U.S. District Court for the District of New Mexico, accusing McDonald’s of gross negligence.

Other documents obtained from McDonald’s showed that from 1982 to 1992 the company had received more than 700 reports of people burned by McDonald’s coffee to varying degrees of severity, and had settled claims arising from scalding injuries for more than $500,000. McDonald’s quality control manager, Christopher Appleton, testified that this number of injuries was insufficient to cause the company to evaluate its practices. “
