Well let’s stipulate that this is a bit of an unusual configuration. Step one, California plainly has jurisdiction over the divorce. The statutory residency period is only six months. So it’s a community property case. They’re spending money like there’s no tomorrow so who knows what there is, squired during marriage, to split.

Is Harry still on the “civil list,” the group of royals the taxpayers of the UK support? Is there some other sort of income? Who has some earning ability? I suspect his is greater than hers. So there’ll be both temporary spousal support before judgment, and I think probably long term support thereafter. Ditto child support. However on the support issue, that will be ameliorated somewhat by the contention that she can work in her former field of acting

The custody issue is fascinating. Having legal custody is not necessarily the equivalent of being able to dictate visitation. I think under the uniform child custody law (UCCJEA,) CA courts would have to follow the British law, but essentially the court would have full authority to make visitation orders.

There are several reddit posters at r/saintmeghanmarkle who claim knowledge of British law WRT line of succession and adoption/surrogacy.

They believe the law is clear that if Meghan used a surrogate, that child is considered “adopted” — regardless of the DNA tests — and is not part of the line of succession.
