Uh-huh and how is this defamation?
"To prove prima facie defamation, a plaintiff must show four things: 1) a false statement purporting to be fact; 2) publication or communication of that statement to a third person; 3) fault amounting to at least negligence; and 4) damages, or some harm caused to the reputation of the person or entity who is the subject ..."
I didn't say it's defamation. Brandon's attorney said it is. The First Amendment does not provide protection in a defamation case. Unless Trump can prove the truth of the statement, it certainly satisfies all of the above elements, though since Brandon and Hunter are public figures it would likely require a finding of actual malice rather than simple negligence. Trump does need to be careful here or he'll find himself a defendant in yet another court case.
