As Americans living in a constitutional republic, we consent to being governed if two fundamental conditions are met:

• We choose who governs us via legitimate electoral processes.
  
  
• Those we choose to govern us are subject to the same laws as those they govern.

If both of these conditions are not met, we do not consent to being governed, and any government in place is illegitimate.

The argument can easily be made on both counts that these conditions are not being met, and we are therefore being governed by an illegitimate government.

They forget that they’re there to serve the people, not the other way around.
