You are correct. If the criminal was attempting to flee with the car or pulled a gun it is a good shoot.

No it's not. The theft already occurred, the guy tracked him down with a tracker on the truck. There was no imminent theft or immediate fleeing. 9.42 isn't going to apply to this case, his only hope is the jury siding with him.
