Its kind of interesting. If parents refuse a treatment that the medical community thinks the minor should have, then they report the parents to CPS and parental authority gets taken away for medical decision making.
What I think is going to happen for these malpractice cases to stick in court is lack of informed consent on future complications and also lack of due diligence in making sure the minor had gender dysphoria. Currently, what I have read, is psych counseling is minimal, and often done by midlevel providers like a psych nurse practitioner who is not trained like a MD. A couple of sessions with a subpar practitioner and hormone treatment is started.
When the lawsuits start piling up, and lets face it, if it goes to court most jurors will side with the patient. Transgender surgery is not a popular thing among the general public. That is when malpractice carriers will refuse to cover this treatment, and also hospital systems .
The same thing happened with abortions at the Kaiser I worked at about 10 years ago. They referred all the abortions out to a non affiliated community clinic because the publicity, hassle, and finding a provider to do this was not worth the headache.
