The department of defense can do what they want but if they piss off a judge on constitutional grounds and authority, even the USCMJ won’t give the DOD cover, especially if the Judge starts to ping on their Civilian overseers.

The judge in the trial had nothing to do with it. The act of applying an opinion and later having to violate HIPAA and the orders of superior to prove it, is another case in itself and will need application of enforcement from a number of different law enforcement representatives.
I don’t write the laws as some are written poorly. I just made mention of one that was in a number of ways in a thread. I welcome anyone to show me a law or policy at the ruling level to prove my information and experience wrong. So far I haven’t had anyone do that here and I’ve displayed a number of laws and military regulations to show what can happen.
