In my experience, only one participant has to have been drinking to get the fight started.
Another thing I remember is your not supposed to even carry in a restaurant that serves alcohol...even just beer and wine.
Being out on the sidewalk was the saving factor for this guy I suspect.
As far as getting into a bar fight while sober......along with a sucker being born every minute, it’s been my studied opinion that there is also a drunk redneck bully looking for a fight born on a regular basis as well.
There’s a fair share of those outside St. Augustine proper.....sooner or later a few are gonna leak in looking for trouble. š
“How do you get in a bar fight before drinking”. Well, say you’re on your way home from work after a long hot summer day, and you’ve worked up a powerful thrist. You know your wife is home cooking your dinner, so you stop in a bar along the way to buy a six pack to go. As you walk up to the bar, a drunken beligerent punk at the bar starts insulting you for no reason, jumps up and slugs you. You tell his buddies and the bartender to get him under control but no one does. He then grabs a pool cue and swings it at your head, barely missing. You try backing away but he continues his attack, now being egged on by his buddies. Situations like this unfortunately happen once in a while.
You are generally correct, states do not allow concealed carry in bars. But there are exceptions. For example, as retired law enforcement I am exempt from my states “prohibited places” CCW provisions. But after a 25 year career as a cop, I never carry when I’m drinking. I drink, or I carry but I never do both at the same time.
